Terms and Conditions

  

Our Terms & Conditions are applicable for all photography bookings. Prior to booking a session with Katie Barker Photography, this contract/these terms are to be agreed by filling in details below.. If you are unsure of anything, or would like further information about these terms, please feel free to contact us. We reserve the right to change these Terms & Conditions at any time.

Pricing & Payment

Following payment of the session fee, the remaining balance is due to be paid before or on the day of the session.  The session fee includes the photographers time and does not include any packages/prints.   The package required must be communicated to the photographer before or on the day of the session.  Editing will not commence until the package has been paid in full.

We reserve the right to adjust prices at any time without prior notice however original prices will be honored for those who have already booked. All prices are £ Sterling (GBP).

It is the Client’s responsibility to make back-up copies of any digital images ordered to a reliable media source.

Payment can be made by Bank Transfer, Cash, or Paypal.

Cancellation

Session fees are non refundable.  The client may cancel this contract within 7 calendar days of the shoot, however, in doing so the client will forfeit the session fee.  Where this contract is cancelled within 7 calendar days of the shoot, then Katie Barker Photography is entitled to full payment of the session and package fee.  In the unlikely event that the photographer has to cancel the appointment, an alternative date will be offered where possible. If the alternative date is not suitable, the Photographer will provide a full refund. 

The Photographer completely understands that illnesses can develop suddenly. For this reason, should a session be cancelled with less than
7 days notice due to sickness, an alternative date will be offered where possible. Only one cancellation with less than 7 days notice are allowed before the session fee is retained.  The re-scheduled date must be no more than 1 month past the original scheduled date otherwise the deposit will be retained.  Late arrivals will be charged the full price for their shoot but cannot unfortunately be guaranteed a full shoot time.

Session Details

The Photographer will end the session at their discretion when it is determined that adequate images in terms of quality and quantity have been captured. The Photographer will make every effort to comply with requests for specific photos. Please ensure these are notified in advance of the sitting. Requests that are felt to be unsafe will be refused. It may not be possible for all of the images requested, or those expected, to be captured.

Natural environment sessions may be rescheduled due to rain, but not overcast weather.  The photographer cannot be held responsible for photographs which could not be captured due to lateness or willingness of subjects.

It is not permitted for the Client or any other connected party to take his or her own photographs, be it on a tablet, phone or camera. This includes location shoots, mini shoots, and studio shoots whether they are paid or promotional shoots.

Viewing & Ordering appointment

The edited images will be viewable either in a private viewing and ordering appointment or online gallery within 2-3 weeks after the shoot for the client to choose their photos.  This gallery contains low quality images.  These images must not be copied, screen shot, downloaded, edited, used on social media, or altered in any way. The proofs are small JPEG files, and their only purpose is for the proof gallery - the final images are processed from high quality RAW files.  The gallery will be active for 2 days (date of gallery opening will be agreed with client).  Clients must review their images and choose their digital images/prints within these 2 days.  Should the client require the gallery to be re-opened after these two days, there will be a £25 charge to do so.   The digital files of all images purchased will be archived.  

Client should make a backup of USB contents on receipt incase of any unforeseen corruption/damage to USB.  If anything is wrong with the USB the client must let Katie Barker photography know within 7 days of receiving the USB.  If USB is damaged/lost and client requires another copy of the contents on USB, this will be an additional cost.

Copyright and Ownership

​© Katie Barker Photography 2023.  The copyright and all other rights in the photos shall be retained by Katie Barker, "the photographer". The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright.

All watermarked or unpurchased images displayed on www.katiebarkerphotography.co.uk or Facebook may be 'Shared', or tagged however please don't remove any of the original post tags/links. You may use images for social profiles but please leave the Katie Barker Photography watermark visible. These images are low resolution proofs without permission to download, print, save or change. All rights reserved.

Image Release

The Client recognises that the Photographer may use any of the session images for business promotion, competitions, instructional purposes or as work samples, including but not limited to via internet (including social media) and promotional material.

Force Majeure

In the unlikely event of total photographic failure, injury or sickness beyond the Photographer’s control, our liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.  Katie Barker Photography holds full Public Liability Insurance.

Complaints

The client should raise any complaints with Katie Barker Photography in writing within 21 days of the client’s USB being received. No refunds will be provided for any reason after this period.

Data Protection

Katie Barker Photography will store Client names, contact details and session information privately and will not share these with any other business or organisation.
